2 DMCS ONE at VISKHAPATNAM and another at TIRUPATI were already FUNCTIONING SINCE ONE YEAR.
WE CAN PROPOSE DMC AT OTHER IMA branches if they actively come forward.

1.A quick and economical pneumonia-sampling device has the potential to save many lives, particularly in developing nations where it is a leading cause of death among children.

4 . The FDA has approved a new treatment - The drug, roflumilast -- carrying the trade name Daliresp -- will be sold in pill form, unlike some other medications for COPD, which are inhaled.

6 . Daily injections of insulin for diabetics could soon be replaced by jabs needed only three times a week.

7. A longer-acting form of insulin, called degludec, works as well as once-a-day medication for patients with type 2 diabetes, a study found.

8. MSD launches diarrhoea vaccine 'RotaTeq' in India

Drug firm MSD, today announced the launch of a diarrhoea vaccine 'RotaTeq' for infants and children in India at Rs 900 a dose and be distributed through three -- MSD Pharmaceuticals, Organon India and Fulford India.

RotaTeq is a pentavalent rotavirus vaccine that helps in preventing rotavirus gastroenteritis, a leading cause of severe and life threatening diarrhoea in young children.(40% of all diarrhoea-related hospital admissions among children aged less than five years).

While the first dosage of the oral three dose RotaTeq vaccine could be administered between six and twelve weeks of age, the subsequent doses need to be given at a minimal interval of four weeks between each dosage. It can be given upto the age of six years.

Recent Drugs Banned in India

Six drugs have been banned in India on 10. 2. 2011.

GS.R. 82(E).—Whereas the Central Government is satisfied that use of the following drugs is likely to involve certain risks to human beings and whereas safer alternatives to the said drugs are available;

And whereas the Central Government is satisfied that it is necessary and expedient to prohibit the manufacture, sale and distribution of the said drugs in public interest;

Now, therefore, in exercise of the powers conferred by Section 26Aof the Drugs and Cosmetics Act, 1940 (23 of 1940), the Central Government hereby prohibits the manufacture, sale and distribution of the following drugs with immediate effect, namely:—

Nimesulide formulations for human use in children below 12 years of age.
Cisapride and its formulations for human use.
Phenylpropanolamine and its formulations for human use,
Human Placental Extract and its formulations for human use,
Sibutramine and its formulations for human use, and
R-Sibutramine and its formulations for human use.

Premium healthcare to be costlier with new service tax:

AC hospitals with more than 25 beds have been brought under the ambit of service tax(10%).

In most cases, of the total bill, 50-70% cost is of medicines and consumables and these cannot be defined as 'services'. However, with this additional new tax, the total sum of the hospital bill including the cost of medicines and consumables will increase by 10% which is an unfair hike.

"This proposed new tax would burden the patients. And to avoid the increase in the costs, the healthcare service providers would not prefer to fall under the organised sector.

while the 20% increase in healthcare allocation to R 26,760 crore may seem good on paper, in actual fact, this just isn’t good enough because it does not take into account the full impact of inflation in the past year. I sincerely believe the time for token hikes is long past. We need bold policy measures if India seeks to become a global model for the healthcare sector.

With a median age of 25.1 years, India’s population profile has the intrinsic potential to make these demographics our advantage. But the mounting burden of chronic non-communicable diseases (CNCDs) such as diabetes, hypertension and heart disease could swiftly wipe out this advantage. The WHO estimates that India could lose $237 billion ( 11000 billion rupees ) in national income due to CNCDs over the next decade. The Budget should ideally have provided a tax benefit to encourage health checkups.

Healthcare on the national agenda would have been the key to unlock India’s potential for unparalleled growth. Unfortunately, I don’t see that happening with the 2011-12 Budget.

DRAFT MEMORANDUM

Dear Sir / Madam,

Indian Medical Association is the largest professional body of modern medicine doctors in India. It has a membership of 1, 98,000 spread over 1600 local branches and 27 state branches. The membership encompasses both Government and Private doctors; medical college teachers and young graduates; specialists and general practitioners. IMA bring to your attention the following facts:

1) Government of India by an ordinance dissolved Medical Council of India in 2010. This brought in a board of Governors replacing a federal and democratic MCI. Government of India is now planning to create a high arching body including non medical technical and management education obliterating the unique identity of medical profession. Government has no mandate to alter institutions in a way that could interfere with the constitutional guarantee to life. We,

a) Condemn the dissolution of MCI

b) Demand that the nominated Board of Governors of MCI be dismissed forthwith.

c) Demand restoration of MCI to its original character and form with representatives from each state.

2) IMA strongly condemns the arbitrary and autocratic decision of the adhoc MCI to introduce the National Entrance examination for MBBS course and thank the Government of Tamil Nadu for opposing this move. The Central Government must not implement this scheme till all the students are exposed to nation wide uniform common syllabus.

3) IMA resolve to oppose the move of MCI and Ministry of Health to introduce three year BRHC course, thereby producing half know ledged Medical practitioners and leaving rural Indians at their mercy for health care. The BRHC course should be stopped and more regular Medical College shall be started in rural areas and special reservations shall be given to rural students in these colleges.

When the urban population is being offered the best of healthcare, why is the rural population being asked to work with sub-standard healthcare service providers? The IMA cannot support this discrimination.”

“It is a violation of Article 14 of the Constitution, which gives each citizen the Fundamental Right to equality. This new course violates the Indian Medical Council Act, 1956, as per the Section 15 (2) (b) of the Indian Medical Council Act, 1956.

The minimum qualification to register for a medical practitioner under the Indian Medical Registry is an MBBS degree. The Medical Council Act categorically prohibits any person or body, including the State government, from starting sub-standard new courses for medical education/ training to produce doctors.

“There are better options available with the Union and State governments for providing medical care to our rural people, like opening more medical colleges in rural areas, one year compulsory rural service for medical graduates with the government giving incentives like preference in post-graduate selection and special rural salary structure.”

4) In its wisdom the Lok Sabha passed the Clinical Establishment (Registration and Regulation) Act 2010 to regulate the hospitals of this country without even a semblance of discussion. This law effectively brings in a license raj. Every clinic and hospital in this country has to renew its license once in three years. There are already more than 43 laws governing the hospitals. By imposing a license raj a vibrant health sector is being targeted. IMA is concerned about the negative impact on the health of the nation by such retrograde regulation. We demand

a) Single window for all legislation on a hospital

b) To do away with licensing

c) Provide for online registration and independent voluntary accreditation process.

5) Quackery has become a menace in our state. To safeguard the public and also ensure smooth practice for all the qualified Allopathic and other system of Doctors an ANTI QUACKERY BILL must be enacted by the Government.

6) The existing vacancies of Professors and Associate professors in various Medical colleges must be filled in immediately to sustain the standard of medical education in our colleges.

We the members of Indian Medical Association express our anguish over the lackadaisical approach of Government of India over matters of great importance to the health of our people. We kindly request you to use your good offices to reflect our concern and demands to appropriate authorities.

This is the bitter statement issued by dr.srihari- reputed sonologist of tirupati. after went through hard moments in getting service for his newly purchased 35 lacs scan machine and put it in working condition, dr.srihari facing lot of turmoil in repaying the EMIs to finance company.

What IMA can do to the success of RNTCP DOTS

IMA APSTATE GFATM RNTCP UNIT-I workshop/ review meet was well organized by Dr.G.S.MURTY & DR.P.S.SARMA IN KAKINADA ON 30-1-11,which was actively participated by all stake holders.

contribution of IMA towards success of RNTCP methodology in fighting against T.B. is well appreciated by one and all.

My observations and submissions to the meet :

It’s wonderful that we have treated 1.3 crore patients and averted almost 20lac deaths since we have started RNTCP in 1997.

It’s also pleasant to hear the words of K.S. Sachdeva, Deputy Program Manager, Central TB Division that we have achieved case -detection rate of over 73 per cent and a treatment success rate of over 87 per cent in 2010 against the global benchmark of 70 and 85 per cent respectively.

Its heartening to note that we have 19 labs having equipped to do newer “molecular-based Line Probe Assay”, which can diagnose MDR-TB in 48 hours as compared to 6-12 weeks taken by conventional tests.

But still there are more challenges lurking to get our serious attention -

A. multi-drug resistant TB (MDR-TB) and

TB-HIV co-infection and
Another big hurdle is lack of coordination between functional dynamics of public and private players.

D. Still, irrational treatment is the main culprit in emergence of MDR-TB

So,what should the govt. do?

1. Addressing and implementing the program in cemonk centers,geriatric ashrams,paediatric hospitals.

2. The current diagnostic test - sputum microscopy -for TB has been used for 125 years and its not ideal because it doesn’t easily detect the growing number of strains that are resistant to antibiotics, or TB where the patient is also infected with HIV. We have to introduce newer diagnostic test promoted by Dr. Mario Raviglione, Director of the WHO’s Stop TB department which delivers a result in 100 minutes.

3. “Unfortunately, the antibiotics we use to fight TB aren't effective against latent TB and can only be used when the disease becomes active. This is a major problem as 1 out of 10 people who have latent TB will develop the active disease, becoming sick and contagious.”

“If we can figure out a way to treat TB when it's in a latent stage, then we could save millions of lives throughout the world.”

some suggestions to improve this prestigious PPM project are-

What IMA can do?

1. Peer to peer re-sensitization program which will give better results by converting more private physicians in to referral doctors and DOT providers.

2. Involving local IMA branches to establish DMC. By this,we can mitigate apphrensions of private doctors of loosing patients thus involve more private doctors to adhere to the concept of RNTCP.

3. APPOINTING local mobile sputum collector –to collect specimens, to process and to deliver the reports to doctors in a stipulated area.

The karnataka government on Monday ( 24-1-11) told the high court that Medical Council of India has given its nod for the course and that an appropriate application will be filed seeking the course's inclusion at the PG level for academic year 2012-13 in 10 government-run medical colleges.

The government recently announced that it would dissolve the Medical Council of India and a new medical body will be formed under the new Clinical Establishment Act, 2010, which is to be implemented soon.

According to this act, any doctor wanting to set up a clinic in any area will have to first take permission from that body before he starts up.

"The first condition is that the area where the doctor wants to have his practice should not have more than 10 doctors. Then they want that clinic be on ground floor or first floor and have also specified how much area and what drugs to keep, et cetera.

A big and common problem faced today is that of snoring which occur due to narrowing of the airway passage. Snoring can affect the quantity and quality of your sleep. Poor sleep can lead to daytime fatigue, irritability and increased health problems.

Snoring can be controlled and for that certain things should be avoided like large meals, Dairy products, Soymilk, Alcohol, Sleeping pills and other relaxants, Antihistamines and Caffeine.

Along with this, throat exercises can be a cost-effective snore reducer for people with mild to moderate sleep apnea.

According to certain studies, by pronouncing certain vowel sounds and curling the tongue in specific ways, reduce snoring like;

- Repeat each vowel (a,e,i,o,u) out loud for three minutes throughout day.
- Place the tip of your tongue behind your top front teeth. Slide your tongue backwards for 3 minutes a day.
- Close your mouth and purse your lips. Hold for 30 seconds.
- With mouth open, move jaw to the right and hold for 30 seconds. Repeat on left side.

Apart from these exercises, keep changing your position while sleeping, like lying on the side helps reduce snoring.

Avoid smoking. Smokers tend to suffer from a higher chance of snoring.

The Indian Medical Association (IMA) has described the endorsement of the Union Government's decision to start a Bachelor of Rural Health course at the meeting of State Health Ministers in Hyderabad on January 12-13 as “unfortunate” and "retrograde".

IMA members all over the country said they will strongly oppose the move to produce half-baked doctors for the rural population.

Association national president Vinay Aggarwal said: “This group of doctors, according to the Centre, is being created mainly for the rural section. When the urban population is being offered the best of healthcare, why is the rural population being asked to work with sub-standard healthcare service providers? The IMA cannot support this discrimination.”

Association secretary general D.R. Rai said: “There are better options available with the Union and State governments for providing medical care to our rural people, like opening more medical colleges in rural areas, one year compulsory rural service for medical graduates with the government giving incentives like preference in post-graduate selection and special rural salary structure.”

The IMA says it will now appeal to President Pratibha Patil to look into the matter. “We will also organise a dharna and observe an all-India protest day in all the State and local branches of the IMA on January 22. We will also submit a memorandum, highlighting our reservation to the introduction of the new course and other challenging issues related to medical profession to all the relevant government departments all over the country,” noted the release.

Proposed changes to the MBBS curriculum

The MCI's Undergraduate Education Working Group has asked medical colleges and stake holders from across the country to provide feedback and suggest further changes to the draft proposal by January 17, after which the final draft of the policy will be formulated.

Proposed changes to the MBBS curriculum

* The duration of MBBS course will be 4 years now instead of four-and-half

* One year internship after the course remains unchanged

* Students have to study electives for six months within the four-year timeline

* Only two exams- one at the end of four years and another after completing internship

* Clinical exposure or rather direct brush with patients to begin from first year

* A mandatory set of skills will be set for students and only after certification of those skills can they get license to practice

* Each medical colleges to be linked to a local hospital including community health centres, taluk hospitals and primary health centres that will act as their training ground

* Contemporary approach to education such as skills lab, e-learning, m-learning and simulation

* Flexibility in curriculum

More than the e-health, mHealth could be the key to a better life for the masses in developing countries.

The groundbreaking "mHealth for Development" study produced by the UN/Vodafone Foundation Partnership lists more than 50 mHealth programmes from around the world, showing the benefits that mobile technology can bring to healthcare provision.

Simply connecting rural areas with city doctors using mobile broadband would allow the provision of better healthcare to more people, and many of the initiatives to date have focused on that kind of connection, it is pointed out.

A band of paramedics in a mobile broadband-equipped van visited the villages and were able to cover vast areas, referring many queries back to doctors in major cities.

In India, there are 1m people that die each year purely because they can't get access to basic healthcare, it has been pointed out.

Because 3G mobile technology is cheap and easily made widespread, comparatively small amounts of investment can wreak great change in these so-called emerging markets

The union health ministry and Medical Council of India (MCI) are now on a collision course over the proposed common entrance test for all MBBS and PG medicine courses in the country.

Two days after TOI reported on MCI's notification making the national eligibility-cum-entrance test (NEET) mandatory for admissions to all medical courses, the health ministry has directed MCI to withdraw the notification 'with immediate effect'. But MCI has decided not to recall the notification saying it was issued based on the apex court's nod on December 14 and the affidavit filed by the union health ministry in support of CET.

1. MCI notifies new test for all medical admissions in country : the Medical Council of India (MCI) has issued a notification on 21-12-2010, making the 'National Eligibility-cum-Entrance Test' (NEET) as the sole qualification for MBBS as well as post-graduate medical admissions in all medical colleges across the country.

Marks obtained in mathematics in Plus Two too would be considered for admission to the MBBS course.

An all-India as well as a state-wise merit list of candidates should be prepared on the basis of the marks obtained in the NEET, and the minimum marks for admission to an MBBS course would be 50%. It would be, however, 40% per cent for SC, ST and OBC candidates, and 45% for disabled persons.

"No candidate, who has failed to obtain the minimum eligibility marks shall be admitted to MBBS course in the academic year (concerned)," the notification states.

What is most controversial about the whole notification is the fact that the NEET had been made the sole admission criterion for 'all' admissions, including those being offered by unaided minority/non-minority institutions.

2. NCHRH : the Centre will have the powers to supersede the NCHRH and all bodies under it, if necessary, in “public interest”.

The National Board of Examinations (NBE) will be disbanded . the National Board of Examinations, established in 1860, will be dissolved and its functions taken over by the National Board for Health Education (NBHE) to be set up under the proposed law.

the Board will determine, coordinate and maintain standards for health education and research; specify minimum requirements in terms of faculty, infrastructure and clinical workload for establishment of institutions for the discipline of health; lay down curricula for examinations; design and approve new courses of study on the recommendations of the institutes, hospitals and universities; undertake faculty development programmes; specify the schedule of admission for various courses; and importantly, conduct examinations for all under-graduate, post-graduate, doctoral, post-doctoral and diploma courses, fellowship programmes and screening tests.

It will specify parameters defining the equivalence between academic qualifications granted by different health institutions in India and abroad and lay down norms and mechanisms for transparent, efficient and accountable governance in a health university or higher health educational institution.

At the same time, it will approve and notify standards of academic quality for accreditation and benchmarking of education in recognised health institutions

Economic growth is fine but a lot needs to be done for human development

in the midst of the great economic success, India also continues to fail on several fronts. Here is a brief look at 10 reports released in 2010, which highlight corruption, inadequate infrastructure, widespread poverty and lack of social facilities:

Since 1948, graft has cost India $462 bn: Year 2010, corruption hit the headlines, be it the 2G or the Commonwealth Games, with each scam breaking records. But a report by the Washington-based think tank Global Financial Integrity (GFI) put the matter in the historical perspective. “The corrupt have drained India of $462 billion (about Rs 20.8 trillion) between 1948 and now,” the report said.

Another TI report found political parties to be the most corrupt institution in India followed by the police.

Eight Indian states have more poor than 26 African countries: As per the Multidimensional Poverty Index (MPI), there are more poor people in eight Indian states (a total of around 421 million in Bihar, Chhattisgarh, Jharkhand, Madhya Pradesh, Orissa, Rajasthan, Uttar Pradesh and West Bengal) than in the 26 poorest African countries combined (410 million), said a report brought out by the United Nations Development Programme (UNDP) and Oxford university.

India among the worst places for a mother: According to its report, 70,000 women lose their lives due to pregnancy or childbirth complications. In a different report the organisation noted that India had the highest number of underweight children and children with severe acute malnutrition in the Commonwealth countries.

Girls in Indian cities live in fear: Sixty-nine percent of the girls surveyed felt cities offer an unsafe and insecure living environment and 74 percent felt most vulnerable in public places, said a report by the Plan India.

Position of the women of India also came in a UNDP report which said that women were respected more in Pakistan and Bangladesh than in India.

Open defecation – India’s shame: A report by WHO-UNICEF said that Indians comprised 58 percent of all people who defecate in the open despite decline in open defecation worldwide. A UN University study said more people in India have access to a cell phone than to a toilet and improved sanitation.

Also, inadequate sanitation costs a whopping $54 billion in 2006 - close to 6.4 percent of the country's GDP - according to a World Bank study. The Mumbai suburban rail network has a shortfall of 12,000 toilet seats, said an Observer Research Foundation (ORF) report.

India's metros cut a sorry figure in global rankings: The best rank in a list of 65 cities across the world that an Indian city has managed is 45 - Delhi, followed by Mumbai at 46. Bangalore and Kolkata are at the fag end, at 58 and 63 respectively. Thesurvey was conducted by Foreign Policy, a US journal, in collaboration with A T Kearney and the Chicago Council on Global Affairs.

India lacks surgical facilities: This report may take the shine off as India being preferred medical tourism destinations. A study done by Harvard School of Public Health showed that the surgical facilities in India and Pakistan are very poor, as two countries have just 1.3 OTs per 100,000 people. There is an acute absence of basic surgical equipments in the operation theatre in Indian hospitals, said the study.

Indian can’t even treat pneumonia patients as per this report by the International Vaccine Access Centre (IVAC) which said pneumonia claims the lives of 3,70,000 children aged under five in India.

India lags behind on MDGs: Ten years after the signing of the Millennium Declaration, “India appears to be seriously off-track on a number of MDGs including those on hunger, infant mortality, maternal mortality, and women’s empowerment,” said a report by Wada Na Todo Abhiyan (WNTA), a civil society effort to track government performance in alleviating poverty.

India’s budgetary allocations for achieving the Millennium Development Goals (MDGs) are inadequate, said a study by the Centre for Budget and Government Accountability (CBGA), which questioned India’s will to achieve goals.

Child marriages rampant in India: Even as India makes significant progress in many areas, child marriages continue to be rampant in some states. At least 50 percent women in the country get married before attaining the age of 18 years, says astudy done by the Population Council of India.

India's slum population swelling: India’s economic growth may or may not be a white elephant but the slum population in the country is reaching a mammoth size. The slum population has risen by as much as around 23 percent since 2001, said astudy prepared by the government of India.

So all the reports above mentioned contradict the rosy growth story of India in terms of GDP. A lot needs to be done before India could fancy a leadership chance at the international forum.

SC backs MCI on common MBBS entrance exam

The newly-constituted Board of Governors of MCI had on July 29, 2010, approached the Central Board of Secondary Education (CBSE) to work out modalities for introduction of a common entrance exam system from 2011.

The Board, has also approached private medical colleges with the proposal which in turn have agreed to it.

Admission tests are conducted yearly for nearly 32,000 undergraduate seats and 13,000 post graduate seats in medical colleges across the country.

This press meet is convened to clarify the stand of AP Medical Council on the controversial issue of can a MBBS Doctor do Surgeries.

(1) MBBS Degree itself says Bachelor of Surgery & Bachelor of Medicine.

(2) In the MBBS Course a student will have 6 months Surgical Ward posting and later Specialty Surgical Postings. In Houseman ship he is posted in Surgical Ward for 2 months & 1 month is Surgical Specialties.

(3) As per the curriculum, they are trained in minor Surgical Procedures, Obstetrics procedures.

(4) The National Consumer Forum found fault with the Doctor because he falsly claimed that he is M.S. Surgeon in reality he was not a M.S. and did Major Surgical procedure causing damage to the patient.

(5) There is no controversy that a MBBS doctor should not do Major Surgical Procedures as pointed out by National Consumer Forum.

What Can an MBBS Doctor do:-

(1) He can do all the Minor Surgical Procedures for which he is trained in MBBS Course and Houseman Ship.

(2) He can do Deliveries and its related to procedures as trained.

(3) He can do National Programmes like Tubectomies & Vasectomies.

(4) In emergencies if a qualified surgeon is not available in the near vicinity as a life savings measures he can do first aid and a Surgical Procedure based on his experience.

(5) He should not do Elective Major Surgical procedures and the care should taken to refer to a nearby Hospital where a Surgeon / Gynecologist available.

ENTITLENESS OF MBBS DOCTOR TO CONDUCT SURGERIES VISA-VIS RULE POSITION AS LAID DOWN IN IMC ACT 1956 AND IMC REGULATIONS 2002 AS AMENDED IN 2004 & 2009.

(1) There is no provision in IMC Act, 1956 which prohibits MBBS doctors to do surgeries. Surgery is a main subject during the 4 ½ years course of MBBS. During clinical postings, they treat surgical patients under the supervision of the Experts. During the 12 months period of compulsory rotating internship, the internees are posted at least for 2 months in Surgical Departments and they have to treat surgical patients during this period.

(2) The entitleness of registered Medical Practitioners is specified in Section -27 of IMC Act, 1956 as follows.,

“Subject to the conditions and registrations laid down in this Act, every person whose name is for the time being borne on the Indian Medical Register shall be entitled according to his qualifications to practice as a medical practitioner in any part of India”.

(3) The Hon’ble Supreme Court’s Judgement in Poonam Verma Vs. Ashwini Patel case, has taken into consideration of the decision of Privy Council in the year 1937, reported as 1937 1 MLJ 197.

In this case, the Hon’ble Supreme Court made an attempt to discuss the application of the doctrine “SIC UTERE LEO UT ALIENUM NON LAEDAS” in the practice of medicine. This means “so use your own that you harm another’s” (AIR 1996 SC 2111).

This refers to the practice of medicine by unqualified persons.

(4) In all cases where allegations were made against doctors for their negligence, the Hon’ble High Courts or National Commission or Supreme Court expressed the view that a doctor is not negligent when he has observed standard protocols during the course of his practice.

(5) In all cases, the Constitutional Courts or the State Commissions or National Commission have taken into consideration of the provisions of IMC Act 1956, IMC Regulations, 2002 together with Consumer Protection Act, 1986 having due regard to the facts and circumstances of the case.

(6) The Principle laid down by Hon’ble Supreme Court in Baldeo Raj Vs Urmila Kumari (AIR 1979 SC 879) is “The practitioner may not have specialized in the branch of medical treatment of women’s disease, but her knowledge of midwifery as an obstetrician prove to be of the high order in the case itself”. In this case Hon’ble Supreme Court reversed the finding of Hon’ble Punjab and Haryana High Court, which had held that “as the practitioner is question has not a special study on the subject and as such she cannot be considered as an expert and her evidence is not admissible”.

IMA is serving the humanity by sensitizing and empowering the doctors and public to various social maladies and epidemic out breaks and natural disasters .off late some agencies, persons and constitutional bodies criticizing the IMA regarding endorsements and questioning the ethical & moral values of IMA BY IGNORING CONVENIENTLY the service, it's delivering.

one thing, i have to impress is that our IMA is doing what ever is the best for achieving those objectives registered under societies act. its a normal practice for all NGOs in the world , doing various projects by entering in to business agreements & endorsements with various companies. Govt & MCI are very eager to introduce SHORT TERM TRUNCATED COURSE - BRHC , Which is a retrograde and degrading step . they can non-chalantly amend some acts to suit their whims & fancies which is a blatant violation of the indian medical degrees act and MCI act.But these authorities are not bothered to amend and empower the acts and IPC sections to prohibit the quacks in our country.

some recent decisions of MCI with out considering the cross opinion of all stake holders -

1. Extending the age limits up 70 yrs , which facilitates retired segment those already getting pension and other benefits . If the MCI really worried about the shortage of faculties then they could have allowed thousands of PG diploma holders for the faculty positions in respective branches with certain criteria like research publication or extended time duration like 5 yr of senior resident ship. After all there is only the difference of thesis and one extra year in the residency which does not guarantee of superior quality.

2. MCI is reducing the number of posts of asst. and associate professors per unit jeopardizing training of the quality clinical skills.
3. MCI has been reduced minimum quality requirements to establish mushrooming of medical schools nationwide with out taking consideration of demand & supply. our existing medical schools in south india are producing enough MBBS doctors but what we need are specialist doctors. with vast demographic variations there is a varied demand and supply. and with known fact that the north india ,western india and north eastern india needs more medical colleges, the decision must be applicable to only those deficit parts instead of nationwide.
The authorities has wasted plenty of time by disallowing the DNB holders as teaching faculty.

EVERY ONE IS TARGETING THE DOCTORS negatively with Consumer protection act,criminal negligence ,SC&ST atrocities act and any act that suit their venegence and adding salt to the wound , manhandling the doctors and destroying costly equipment and blowing & sensitizing the issues in media.some one proclaims the hospitals are factories and industries and eager to slap labour act,corporate tax , sales tax, commercial tax and excise tax.some one says the doctors are bandikoots.another one eager to collect luxury tax from hospitals thinking that the healthcare is luxury.some one says that medical records must be kept for 3yrs ,ignoring that the valuable documents of the govt never be kept even for one year.
what the society think of doctors ? proclaiming that doctor's profession is noblest one and beating them to the hallow is like hanging the Damocles sword over the necks of doctors. its a dangerous paradox of our country.
Qualified Doctors in our country have to comply with 41 types of acts and regulations,but the tragedy is, leaving the quacks let loose and allowing what ever they want.
it shows that Health authorities and MCI doesn't care about quality medical education and quality health care delivery and in course they are encouraging the urban-rural disparity & discrimination.
every politician ,media and authorities interested in crticising the doctors for all maladies and deficiencies of nation's health. They are not talking about spurious drugs,deficiency in health infrastructure, lacunae in vaccine cold chain,deficit of drug testing labs ,quackery,unqualified labs and deficiency of paramedic&nursing staff.
Remember,health is different from health care. Doctors are one small bolt in this gigantic health machinery. seeing the health spectrum with narrow vision and making the doctors scape goats has became a habit of every one in our country.

IMA attacks MoH, MCI over suspension of its top office-bearers ...

The Indian Medical Association today launched a frontal attack on the Health Ministry and the Medical Council of India for suspending its President and Secretary for endorsing products.

"The IMA is registered under the Societies'' Act.

Only violation of any Section of Societies'' Act can invite action on IMA. There has been no violation of the provisions of this Act. MCI has no locus standi on IMA.

IMA asserts its right to convey health information to the people," it said in a statement here.

The IMA said that the state medical councils are the competent authority to register as well as take any disciplinary action on any registered medical practitioner and MCI could only make recommendations to the state medical councils.

"The recommendation of MCI is not binding on the state Medical Councils," it added.
The IMA said that the "duly elected members of MCI have been removed and at present only an ad-hoc council appointed by the Government of India existed.
"at present the MCI is a stop gap arrangement. This body has not been vested to perform duties of an ethics committee," it said.

IMA is complaining , that the govt.of india has ulterior political motives in making victimization of IMA officials , as IMA is staunchily opposing the concepts of BRHC, CE ACT ,NCHRH. its nothing but suppressing the fundamental rights and vindictive attitude towards medical profession.

On November 19, Union Health Minister Ghulam Nabi Azad in response to a written question in Rajya Sabha had said that the National President and Secretary General of IMA have been suspended from Indian Medical Register.

Resolutions taken by IMA at its 204th. CWC meet:

“204^th CWC of IMA held at Visakhapatnam on Monday, 22^nd November, 2010 strongly condemns the highhanded action of MCI in suspending the National President and Hony. Secretary General of IMA from the Indian Medical Register and censuring the Central Working Committee members of IMA.”

“204^th CWC of IMA held at Visakhapatnam on Monday, 22^nd November, 2010 resolves to fight the issues of BRMS/BRHC, Clinical Establishment (Registration and Regulation) Act 2010, proposed high arching Body instead of MCI and national exit test for MBBS graduates with all its might.”

The above resolution shall be forwarded to the Hon’ble President of India, Hon’ble Prime Minister of India, Ministry of Health, Chairperson of UPA, Leader of Opposition, other Specialist organizations, State Medical Councils, Press and Media. Fevers broadly fall into three categories.

Bacterial Infections
Viral Fevers
Parasitic Fevers

Bacterial Infections:

High fever with cough, sputum and shortness of breath, are typical symptoms of respiratory tract infections. Urinary tract infectionscause high fever with chills and rigour. Frequent urination accompanied by a burning sensation or discomfort in the abdomen are additional symptoms. In the case of infections of skin or soft tissueswelling occurs in the affected region, while fever associated with vomiting, loose stools with mucus or blood and abdominal pain point out to gastrointestinalinfection. These infections need antibiotic treatment.

Viral Fevers:

Dengue: Highfever accompanied by severe headache, body pains, backache and joint pains mark this disease. A red rash can also occur. In rare cases the platelet count decreases and lead to bleeding episodes, known as dengue haemorrhagic fever.

Chikunguniya: It is almost like dengue but less dangerous. Severe joint pains may last for weeks and months.

Viral hepatitis A or E: Patients have low grade fever. Appetite decreases due to nausea and yellow discolouration in the eyes can be seen on the 4^th day.

Remember The viral hemorrhagic fevers (VHFs) are a diverse group of animal and human illnesses that are caused by four distinct families of RNA viruses: the Arenaviridae,Filoviridae, Bunyaviridae, and Flaviviridae.

The Arenaviridae include the viruses responsible for Lassa fever and Argentine, Bolivian, Brazilian and Venezuelan hemorrhagic fevers.
The Bunyaviridae include the members of the Hantavirus genus that cause hemorrhagic fever with renal syndrome (HFRS), the Crimean-Congo hemorrhagic fever (CCHF) virus from the Nairovirus genus, and theRift Valley fever (RVF) virus from the Phlebovirus genus.
The Filoviridae include Ebola and Marburg viruses.
Finally, the Flaviviridae include dengue, yellow fever, and two viruses in the tick-borne encephalitis group that cause VHF: Omsk hemorrhagic fever virus and Kyasanur Forest disease virus.

Parasitic fevers:

Malaria: Patients suffer from high fever with chills and rigour. As soon as the fever subsides the sweating is profuse. Headaches and body pains is common and the fever can sometime lead to anaemia and jaundice.

Filaria: Temperatures can go up to 103-104F with chills and rigour. Pain and swelling in the groin and lower limbs is observed.

Typhoid: High grade fever with headache and body pains. The patient may also have persistentcough , constipation or diarrhoea.

Viral and parasitic fevers can be identified through requisite tests. While viral hepatitis and typhoid are caused by contaminated water and food the rest are caused by mosquito bite. All these can be prevented by taking the needed precautions.

FACT FILE:

Avoid drugs like aspirin, ibuprofen and dyclofenac as they can cause gastrointestinal side-effects and affect the platelet count.
Bacterial fevers respond to antibiotic treatment. Viral fevers don’t.
All fevers don’t respond immediately to medication. Viral fevers take a week’s time to resolve.
Vaccines are available for typhoid and Viral hepatitis A
Infants below one-year need to be sponged to bring the fever down. High fever in infants can cause fits.

Scientists have developed an automated test that can rapidly and accurately detect tuberculosis and drug–resistant TB bacteria in patients.

To use the test, a technician adds a small sample of a patient’s sputum to a plastic test cartridge and loads it into the machine. The instrument then automatically performs a series of steps that ultimately leads to an analysis of DNA from bacteria in the sample. A computerized printout reports the presence of TB bacteria and whether or not the bacteria are resistant to RIF

In addition, a single MTB/RIF analysis detected TB in over 72% of patients who did not appear to have TB according to smear microscopy but who were later found to have TB in culture tests.

The scientists note that the MTB/RIF test makes it possible to detect TB and drug resistance in a single clinic visit and perhaps begin treatment immediately, a significant advantage in developing countries.

Technicians can't run pathology lab: GUJARAT HC

The Gujarat High Court has ruled that technicians can't run pathology laboratories independently because they are not qualified pathologists.

The pathologists association had approached the high court more than a decade ago seeking directions to the state for taking action against those running pathology laboratories without requisite qualification. After a prolonged hearing, the court concluded that technicians can't directly give a report without authentication by a pathologist registered with the Medical Council of India (MCI).

"Though it is open to any person or institute to run a pathology laboratory, but no report can be issued without the signature or counter signature of the practicing pathologist recognised by the Medical Council of India," the bench headed by Chief Justice S J Mukhopadhaya ruled and directed the government to ensure that no pathology laboratory is run by an unqualified person.

However, if the laboratory is run by a pathologist or engages a pathologist registered with MCI, the government could allow it to function.

Medical council eases norms to set up colleges

The Medical Council of India (MCI) governing body suggested to relax the norms for the setting up of new medical colleges.

All this involves a change in the student to bed ratio in collegiate hospitals to 1:5 from 1:8 and increasing the retirement age of its teachers to 70 years from the present age of 65 years.

MCI member Devi Shetty, chairman of Narayana Hrudayalaya said, “The retirement age has been increased to retain experienced and talented teachers and to overcome the faculty shortage that medical colleges across the country are facing,”

The decision followed after a meeting of the MCI held in Delhi on Saturday. The MCI has also reduced the land requirement to 10 acres from the present 25 acres.

It has also been decided that from now on medical colleges can take up to 250 students as against 150 earlier. As per the MCI, India faces a shortage of 7.5 lakh doctors and expects almost 100 new medical colleges too come up every year across the country.

Adding another test to the numerous of tests and examinations medical students have to appear, the Medical Council of India (MCI) has submitted a recommendation for a ‘common-exit test’ which is under active consideration of the Health ministry, the Supreme court was informed on Friday(17-9-10).

Reports say that the exit test will be in the lines of the exam which the Bar council of India conducts for law graduates. The lawyers can practice in courts only after clearing the mandatory exam.

MCI & GOI's SUBMISSION TO APEX COURT:

The central government Friday (17-9-10) informed the Supreme Court that it had finalised the rules and regulations for all India common entrance test (CET) for post-graduate medical courses,

and it wanted to notify it within a week.

There would be centralised counselling after the CET and at the end of the course there would an exit test for doctors. BUT, The Bench directed the matter to be listed after a week ( ABOUT LAST WEEK OF SEPTEMBER-10).

The court was also told that an earlier announcement by the Medical Council of India (MCI) for holding a common entrance test FOR MBBS was deferred due to opposition from the Tamil Nadu government.

MCI's RULES FOR TEACHING FACULTY:
According to MCI rules, a candidate should have at least three years of teaching experience as lecturer to become an assistant professor and should be five years old in the post of assistant professor to qualify as professor”.

As the controversy over the origin of the new antibiotic-resistant bacteria, which non-chalantly named as New Delhi Metallo-beta lactamase-1 (NDM-1) looming large over country's medical tourism prospects, the Union Health and Family Welfare Ministry has set up a task force for evolving a policy on use of antibiotics.

The 13-member task force, chaired by the Director General of Health Services, is expected to submit a report within two months.

Indiscriminate use

According to Union Health and Family Welfare Secretary K. Sujatha Rao, there is indiscriminate use of antibiotics, though most hospitals claim to have a policy on use of antibiotics.

“Once the task force submits its report, we finalise a policy that will have to be adopted by all doctors,” she said. She admitted that there was need to create awareness among medical practitioners on indiscriminate use of antibiotics.

The DGCI, being a regulatory authority, had enquired with the Indian Council of Medical Research (ICMR) on research protocols.

Ms. Rao said the Ministry had also set up a committee to draft National Standard Treatment guidelines. The committee was working in close collaboration with FICCI, and once the guidelines were finalised, it would make insurance meaningful as there would be standardised treatment for ailments.

A patient was brought dead to private hospital. that doctor had never treated him earlier. he cannot ascertain the cause of death with reasonable certainty. The column regarding the cause of death in the prescribed death certificate form has to be filled up by the last attending doctor.

So, technically, he can't sign the certificate. What should that doctor do in such a situation?

Answer : Since that doctor never treated the patient, he or she is not competent to give the cause of death certificate and so ,that doctor should not do so.

Such courses are not recognised by MCI or NBE. What is the medico-legal validity of these courses? Can MCI allow such non-recognised courses? Are they not illegal and detrimental to public interest?

First of all, let it be clear that the NBE has nothing to do with recognizing qualifications awarded by other institutions.

Yes,these courses are not recognised qualifications as per MCI Act.

"If a patient files a complaint in a consumer forum that the doctor treated him for diabetes though he did not have a recognised special qualification, the complaint is likely to fail because an MBBS is competent to treat an ordinary case of diabetes.

"If some mishap happens and the patients files a complaint in a consumer forum that the doctor should have referred him to a specialist in diabetes, the court is likely to give some weightage to the certificate / diploma held by the doctor, especially if it is from a reputed institution.

The MCI has no role in recognizing or de-recognising these courses. It can recognise a course only when the course organiser approaches it for recognition of the course. The organisers of the courses know, that their courses do not lead to a recognised qualification.

The only role of the MCI , is to take action against a doctor who (has undergone such unrecognized courses and on this basis alone), holds out to the public as a specialist in that particular discipline, in violation of the regulation 7.20 of the Indian Medical Council (Professional conduct, Etiquette and Ethics) Regulations, 2002, which reads as follows:

"Regulation 7.20 : A Physician shall not claim to be specialist unless he has a special recognized qualification in that branch".

-- As long as somebody is giving education without false claims and students are applying and paying for it voluntarily and the teaching programme is being conducted as promised, this in itself does not appear to be illegal.
we would view it as continuing medical education. On the face of it, it does not appear to be against public interest. It is in the interest of public that doctors should upgrade their knowledge periodically through whatever means.

Is a non-medical person having the degree of MSC in biochemistry or microbiology competent to sign the laboratory test reports issued to patients? Will it make a difference if the person concerned has been teaching these subjects in a medical college?

that persons holding any other degree for example M.Sc. Microbiology and Biochemistry cannot run pathology lab. Since we have held that pathology is a branch of medicine a person who is not registered in the State Medical Register as a medical practitioner, cannot practice in pathology and cannot sign any certificate or report relating to pathology. If DMLT orBsc MLT or other equivalent qualification are running a pathological laboratory, they should appoint a qualified pathologist as recognised by the state Medical Council and Medical Council of India to certify their reports.

persons having Msc in biochem or microbiology may conduct the test procedures for which they are trained. For that matter, all biochem tests are usually done by auto-analysers. so here we are not disputing about the competency or legality of doing test procedures by these persons.

what the IMC act signifies is,that only medical graduates trained in those faculties(MICRO,BIOCHEM,PATHO) should sign those reports served by either technicians or NON-MEDICAL GRADUATES.

The qualified medical graduate having the degree of concerned faculty-biochem,patho,micro -must attend the laboratory regularly and should perform the reading and should get the tests performed under his supervision and only thereafter can sign the reports.

MCI is preparing a Vision 2015 document to improve medical education.

While trying to increase the number of undergraduate and postgraduate medical seats, MCI is also exploring the possibility of restructuring some of the less popular courses and introducing new ones such as critical and emergency care, infectious diseases and disaster management.

Medical Council of India (MCI) is planning to introduce a new registration system for doctors. As per the proposal, a doctor practising in multiple states will have to register in all those states simultaneously, unlike now when a single registration is enough to practise anywhere in the country.

Similarly, all doctors will have to keep state medical councils updated about the higher degrees, such as post-graduation, they acquire.

14-8-10 NEWS : This important decision, taken by the Medical Council of India and accepted by the Union ministry of health, was conveyed to the Supreme Court on Friday (13-8-10 ) bringing huge relief to lakhs of aspiring doctors.

The ministry of health and family welfare ministry, which has approved the common entrance examination, is expected to issue a notification in this regard shortly.

The exam will, however, not guide admissions to All India Institute of Medical Sciences, Delhi, Postgraduate Institute of Medical Education and Research, Chandigarh, and Armed Forces Medical College, Pune, as these institutes were created by an Act of parliament.

From 2011, those who aspire to become doctors in the country will not have to worry about giving as many entrance tests as possible to get admission to a medical college, modalities of which will be finalised in the next two weeks.

The MCI has plans to set up a nationwide common entrance test (CET) for study of medicine in both government and private colleges.

Such an examination will replace the 17 medical entrance examinations currently existing in the country. As of now, a student aspiring to be a doctor has to sit for at least five to six entrance examinations to get a chance to study in a medical college.

The new CET may be in place from the 2011-12 academic session if the MCI plan gets approved. The Central Board of Secondary Education will be conducting the all-India tests, for admitting 32,000 undergraduate and 13,000 postgraduate students. “The MCI has in principle agreed for a CET at UG and PG levels in the coming years,” Shiv Kumar Sarin, chairman of the MCI board, said here on Tuesday(10-8-10).

“Once a CET is in place, it will no longer matter what economic background you come from if you have the merit. This will change the health education scenario here,” said Sarin, a professor at the G B Pant Hospital in Delhi.

Students will have to apply separately to every college in accordance with their preferences, be it AIIMS, PGI Chandigarh or a private medical college, after taking the exam. A student will need to score in order to get admissions to the colleges of choice.

The MCI proposal for a “single common national entrance” examination was sent to the Health Ministry on

June 24-2010, pointing out that Supreme Court rulings have mandated a common entrance test.

The proposal, a copy of which is with The Indian Express, states:

• There should be only one entrance exam for admission to MBBS course by all institutes across the country, which should be held in English and all scheduled languages.

• The Government should identify an authority for conducting the examination.

• The structuring should be such that it should be evaluated by a computerized mechanism to avoid manual/human interference.

• Admission to all MBBS courses in all medical institutes should be strictly made on the basis of inter se merit of the relevant applicant in the common entrance examination.

• A mechanism be evolved where a list of all students eligible in different states can be segregated from the total list of all eligible candidates. This could be used by state authorities to admit students eligible as per the admission criteria in respective state institutes.

• In institutes of All-India character including deemed universities, institutes owned and managed by the Central government, state governments, universities, local self government trusts/charitable societies and all other organizations, admissions will be based on merit obtained at the competitive national common entrance examination.

THE BACKDROP FOR THIS PROPOSAL :

In response to a petition filed by Simran Jain through advocate A D N Rao had sought a direction from the Supreme court to Medical Council of India (MCI) and the Centre for a single window system for admissions.
During hearing of the petition before a Bench comprising Justices R V Raveendran and H L Gokhale, the decision for one common entrance test was conveyed by MCI counsel and senior advocate Amarendra Saran. Additional solicitor general P P Malhotra said the government had accepted MCI’s suggestion to amend the regulation concerning admissions to medical colleges.

some state IMAs are already in the process of taking advise from Leading advocates. the central IMA has to take action at national level, since the new verdict will affect all the doctors of INDIA.

The important points in this apex court judgment are:-

1. The earlier ruling of taking expert opinion before taking up cases in consumer courts is set aside and made applicable only to criminal cases.

2. Evidence act is not applicable to consumer courts and need not take expert opinion even during trial.

3. If negligence is evident the complainant does not have to prove anything and it is the respondent’s duty to repel the charges. (Quoted 10 examples)

4. The consumer forums should dispose of cases speedily without going into detailed trial.

5. The cases which require detailed trial and evidence, may be referred to a civil court which is at forum’s discretion.

OUR MEMBERS must know the difference between endowment insurance and term insurance.

in the former,we will get risk coverage for the period of time as we pay the premium and at the end of certain period (policy maturation) we will get return back money we paid with some profit and bonus if we survive that policy period. thats why the premiums are high. as the companies do the business with our premium money they can pay back. in unit linked policies companies will invest the money in equities.

in term policies - we will get risk coverage for the premium payment period but at the end of the period we doesn't get back single rupee. that's why the premiums are low.

recently single payment policies, three year payment policies came into the scene which will cover for certain period of time. in these policies,the person has to pay high premiums.

the welfare schemes managed by our IMA are pure term policies. if we compare these schemes with term policies managed by insurance companies, our schemes have following advantages:
